Enclosure

Highlights of
Proposed Property Maintenance Ordinance

Obiective: Separate the Property Maintenance ordinance from
the Uniform State Building Code.

Major changes in the proposed New Ordinance from the existing Boca PM Ordinance.

1. Definitions define nuisance in more detail and areas that weren't covered in old
ordinance are now regulated.

Example: Definition of Inoperable motor vehicle----Means any motor vehicle, trailer
or semi trailer, which is not in operating condition. (Trailer or semi trailer was not
defined in old ordinance)

Example: Wooded lots were not covered in old ordinance. New Ordinance Definition:
"Woodland"~a large, dense growth of trees, plants and underbrush.

Example: Dangerous tree Any tree with an infectious disease or insect problem; dead
or dying that poses a threat to the public health, safety, or welfare of the public.

2. Section 15.5-26 (Penalty)

Penalties are more enforceable - can be assessed by City Attorney or Building Official.
3. Procedure to abate:

a. Only one notice has to be sent or the property can be posted.

b. If the nuisance exists on the same property more than once during a six-month
period, only the initial notification has to be given to correct the violation.
