Enclosure <br /> <br /> Highlights of <br />Proposed Property Maintenance Ordinance <br /> <br /> Obiective: Separate the Property Maintenance ordinance from <br /> the Uniform State Building Code. <br /> <br />Major changes in the proposed New Ordinance from the existing Boca PM Ordinance. <br /> <br /> 1. Definitions define nuisance in more detail and areas that weren't covered in old <br /> ordinance are now regulated. <br /> <br /> Example: Definition of Inoperable motor vehicle----Means any motor vehicle, trailer <br /> or semi trailer, which is not in operating condition. (Trailer or semi trailer was not <br /> defined in old ordinance) <br /> <br /> Example: Wooded lots were not covered in old ordinance. New Ordinance Definition: <br /> "Woodland"~a large, dense growth of trees, plants and underbrush. <br /> <br /> Example: Dangerous tree Any tree with an infectious disease or insect problem; dead <br /> or dying that poses a threat to the public health, safety, or welfare of the public. <br /> <br /> 2. Section 15.5-26 (Penalty) <br /> <br /> Penalties are more enforceable - can be assessed by City Attorney or Building Official. <br /> 3. Procedure to abate: <br /> <br /> a. Only one notice has to be sent or the property can be posted. <br /> <br /> b. If the nuisance exists on the same property more than once during a six-month <br /> period, only the initial notification has to be given to correct the violation. <br /> <br /> <br />
