Council Member Roop moved to adopt the following Ordinance on emergency <br /> <br />basis; the motion was duly seconded and carried by the following roll call vote, with all <br /> <br />members voting: Vote 5 - 0; Yeas (5) - Crabtree, Dallas, Ferrill, Roop, Teague; Nays <br /> <br />(0) - None: <br /> <br />WHEREAS, Martinsville City Council has been advised of <br />complaints relating to persons loitering in, Upon or around the <br />Martinsville Municipal Building and land around it, and, <br />WHEREAS, §15.2-926 of the 1950 Code of Virginia provides that <br />any locality may by ordinance prohibit loitering in, upon, or around <br />any public place, <br />NOW THEREFORE, BE IT ORDAINED by the Council of the City <br />of Martinsville, Virginia, in regular session held on April 23, 2002, <br />that Chapter 13 of the Martinsville Code be, and it hereby is, <br />amended by adding thereto Section 13-23.1, to read as follows: <br />Sec. 13-23.1 Loitering in, upon, or around any public place. <br />It shall be unlawful and a Class 3 misdemeanor for any person to <br />loiter in, upon, or around any public place, including, without <br />limitation, the Martinsville Municipal Building, located at 55 West <br />Church Street, Martinsville, Virginia, and the land that surrounds it. <br />BE IT FURTHER ORDAINED that an emergency exists and that <br />this ordinance shall become effective on and after this date. <br /> <br />Council considered adoption of a Resolution allowing the City to participate in a <br /> <br />Statewide Mutual Aid (SMA) program. City Manager Reynolds stated that 122 of 140 <br /> <br />localities are already a part of the program. It would increase reimbursement from the <br /> <br />Federal Emergency Management Association (FEMA). There is no cost or obligation to <br /> <br /> <br />
