November 13, 2001 Council Member Dallas requested that Staff send letters to George Lester and Fred Martin thanking them for the economic development efforts. Council considered the need to meet in Closed Session. In accordance with Section 2.1-344 (A) of the Code of Virginia (1950, and as amended) and upon motion by Vice Mayor Teague, duly seconded, and by unanimous recorded vote, Council convened in Closed Session, for the purpose of discussing the following matter: A. Consultation with legal counsel, as authorized by Subsection 7. At the conclusion of this Closed Session, each member of Council certified that (1) only public business matters exempt from open meeting requirements were discussed in said Closed Session; and (2) only those business matters identified in the motion convening the Closed Session were heard, discussed, or considered during said Session. Upon return to Open Session, Council took the following action: A. Vice Mayor Teague moved to adopt the following Resolution; the motion was duly seconded and carried by the following roll call vote, with all members voting: Vote 5 - 0; Yeas (5) - Crabtree, Dallas, Ferrill, Roop, Teague; Nays (0) - None: BE IT RESOLVED, by the Council of the City of Martinsville, Virginia, in regular session held on November 13, 2001, that the City Attorney be, and he hereby is, authorized and directed to file a timely and appropriate response on behalf of the City of Martinsville in the case of Commonwealth Boulevard Associates, LLC v. City of Martinsville now pending in the Circuit Court of the City of Martinsville. There being no further business to come before Council during their regular meeting, upon motion by Council Member Roop, duly seconded, by unanimous vote, Mayor Crabtree declared the meeting adjourned at 9:15 P.
