Mr. Knox stated <br /> <br />that he nor the Planning Commission has received any public opposition to this request. <br /> <br />Mayor Crabtree declared the Public Hearing open. Mr. Sanders asked if the City owned <br /> <br />the property for the proposed Cinergy; City Manager Reynolds replied that it is privately <br /> <br />owned. Mayor Crabtree declared the Public Hearing closed. Council Member Roop <br /> <br />moved to adopt the following Ordinance, on an emergency basis; the motion was duly <br /> <br />seconded and carried by the following roll call vote, with all members voting: Vote 4 - <br /> <br />1; Yeas (4) - Crabtree, Ferrill, Roop, Teague; Nays (1) - Dallas: <br /> <br />WHEREAS, American Properties Management Corporation and <br />formerly known as King's Mountain Development Corporation and <br />The Lester Group, applied, pursuant to the provisions Section 15.2- <br />2006 of the Code of Virginia, to have vacated the undeveloped <br />portion a public right-of-way consisting of a road space 30 feet wide <br />and approximately 890 feet long known as Perdue Street, as shown <br />on City Tax Map 11 (1), and, <br />WHEREAS, notice of intention to vacate this portion of Perdue <br />Street has been published at least twice, with at least six days <br />elapsing between the first and second publication, in a newspaper <br />having general circulation in this locality, specifying the time and <br />place of the hearing at which persons affected may appear and be <br />heard, which hearing was held on October 23, 2001 by Martinsville <br />City Council, and, <br />NOW THEREFORE, BE IT ORDAINED by the Council of the City <br />of Martinsville, Virginia, in regular session held on October 23, <br />2001, that the undeveloped portion of Perdue Street be, and it <br />hereby is, vacated pursuant to the provisions of Section 15.2-2006 <br />of the Code, and aforesaid, said vacation to take effect upon the <br />payment of $1,602.00, by American Properties Management <br /> <br /> <br />
