Phillips <br /> <br />WHEREAS, the Virginia Housing Study Commission's Manufactured Housing Subgroup has been <br />directed by SJ437 to study manufactured houses as a way to promote affordable housing and has <br />recommended the following proposed change in the Virginia Code: <br /> <br />15.2-2290.1 Certain manufactured homes deemed same as site built homes <br />"Localities adopting and enforcing zoning ordinances under the provisions of this article shall provide <br />that any new, multi-sectioned manufactured home on an individual lot and on a permanent foundation <br />with masonry shirting shall be defined in all zoning ordinances as a single family dwelling, and shall <br />be permitted in any zoning district that permits single family dwellings constructed to the Uniform <br />Statewide Building Code, subject to development standards that are equivalent to those applicable to a <br />site-built single family dwelling with the same or equivalent zoning districts." <br /> <br />WHEREAS, on October 25th, 2001, the Manufactured Housing Subgroup of the Housing Study <br />Commission voted 8-3 to recommend a revision of the Code of Virginia using said proposed language; <br />and <br /> <br />WHEREAS, said proposal would effectively require that manufactured homes be allowed in all <br />zoning districts which currently allow single family dwellings; and <br /> <br />WHEREAS, the City should retain the authority to decide how to accommodate and promote <br />affordable housing within its jurisdiction as a local decision; and <br /> <br />WHEREAS, said proposal would preempt local building code standards and local zoning authority <br />and serve to erode the locality' s ability to make its own land use decisions; and <br /> <br />WHEREAS, the City recognizes that manufactured housing serves a housing need, it maintains that <br />housing type and location thereof should be a local decision and should not be governed by state <br />mandate; now, therefore, <br /> <br />BE IT RESOLVED by the Council of the City of Martinsville, Virginia, in regular session assembled, <br />November 27th, 2001, that it does firmly oppose proposed revisions to the Code of Virginia as <br />presented by the Virginia Housing Commission's Manufactured Housing Subgroup. <br /> <br />Attest: <br /> <br />Johnathan B.
