169 <br /> <br />October 9, 2001 <br /> <br />to dismiss any tenant and begin the process to have assistance terminated. Currently, <br /> <br />the only way that the City has any authority is if the tenant is convicted of an act of <br /> <br />violence. The only control that the City has over the property owner is a written set of <br /> <br />agreements that the property owner must comply. The only way for the City to withhold <br /> <br />assistance due to a problematic property owner is if a trend exists. If anyone ever loses <br />rental assistance, he or she can never get it back. Council Member Dallas inquired if <br /> <br />the City is liable if people perish due to overcrowding. Mr. Knox replied that the City <br /> <br />would only be liable if the evidence shows that the City was aware of overcrowding and <br />did not do anything. Oscar Cannaday, of 1222 Knollwood Place, Elaine Hedrick, of 108 <br /> <br />Park Street, Gloria Hylton, of 402 Second Street, and Mrs. Pinkard spoke on the issue. <br /> <br />Vice Mayor Teague stated that it is not the intent of Council to prevent Section 8 <br />housing to anyone. Council Member Ferrill moved to adopt the following Resolution; <br /> <br />the motion was duly seconded and carried by the following vote, with all members <br /> <br />voting: Vote <br /> <br />5 - 0; Yeas (5) - Crabtree, Dallas, Ferrill, Roop, Teague; Nays (0) - None: <br /> <br />WHEREAS, the City of Martinsville's Office of Housing Services <br />operates the Section 8 Rental Assistance Program through the <br />Virginia Housing Development Authority; and <br />WHEREAS, several instances of disturbance of the peace have <br />been reported to the City's Office of Housing Services regarding <br />tenants participating in the Section 8 Tenant-Based Assistance <br />Rental Voucher Lease Program; and <br />WHEREAS, the authority is not within the pervue of the Office of <br />Housing Services to terminate assistance to the perpetrators of <br />these instances of disturbance of the peace, as per the guidelines <br />of the Virginia Housing Development Authority; now, therefore, <br />BE IT RESOLVED by the Council of the City of Martinsville, <br />Virginia, in regular session held on October 9, 2001, that said <br />Council does hereby request the Virginia Housing Development <br />Authority to amend its guidelines to authorize the local jurisdictions <br />administering the Section 8 Rental Assistance to be able to <br />terminate such assistance to tenants who, following several <br />complaints, still conduct themselves and/or allow other persons on <br /> <br /> <br />
