ANDREW JOHNSON MAY 21, 2001 AMENDMENTS TO § 13-43 OF THE CITY CODE After receiving a copy of Andy Johnson's letter of April 30, 2001 to Mr. Reynolds on the above, I contacted him about preparing an amendment to §13-43 that in his opinion would enable it to withstand any challenge to its legality, and, based upon what I received from Andy, enclosed is a proposed amendment to § 13-43 that I would ask to be placed on the agenda for the next meeting. It is as follows: BE IT ORDAINED, by the Council of the City of Martinsville, Virginia, in regular session held on May 22, 2001 that Section 13-43 of the Martinsville Code be, and it hereby is, amended to read in its entirety as follows: "Sec. 13-43. Place used for illegal drugs a nuisance; knowingly permitting, establishing, keeping or maintaining such is a Class 1 misdemeanor. Any office, store, shop, restaurant, dance hall, theater, poolroom, clubhouse, storehouse, warehouse, dwelling house, apartment, building of any kind, vehicle, vessel, boat, or aircraft, which with the knowledge of the owner, lessor, agent of any such lessor, manager, chief executive officer, operator or tenant thereof, is frequented by persons under the influence of illegally obtained controlled substances or marijuana or is used for the illegal possession of, manufacturing or distributing controlled substances or marijuana, shall be deemed a common nuisance. Any such owner, lessor, agent of any such lessor, manager, chief executive officer, operator or tenant who knowingly permits, establishes, keeps or maintains such a common nuisance is guilty of a Class 1 misdemeanor. BE IT FURTHER ORDAINED that an emergency exists and that this ordinance shall be effective on and after this date."
