ANDREW JOHNSON <br />MAY 21, 2001 <br />AMENDMENTS TO § 13-43 OF THE CITY CODE <br /> <br /> After receiving a copy of Andy Johnson's letter of April 30, 2001 to Mr. Reynolds on the <br />above, I contacted him about preparing an amendment to §13-43 that in his opinion would enable <br />it to withstand any challenge to its legality, and, based upon what I received from Andy, <br />enclosed is a proposed amendment to § 13-43 that I would ask to be placed on the agenda for the <br />next meeting. <br /> <br />It is as follows: <br /> <br /> BE IT ORDAINED, by the Council of the City of Martinsville, Virginia, in <br />regular session held on May 22, 2001 that Section 13-43 of the Martinsville Code be, and <br />it hereby is, amended to read in its entirety as follows: <br /> <br />"Sec. 13-43. Place used for illegal drugs a nuisance; knowingly permitting, <br />establishing, keeping or maintaining such is a Class 1 misdemeanor. <br /> <br /> Any office, store, shop, restaurant, dance hall, theater, poolroom, clubhouse, <br />storehouse, warehouse, dwelling house, apartment, building of any kind, vehicle, vessel, <br />boat, or aircraft, which with the knowledge of the owner, lessor, agent of any such lessor, <br />manager, chief executive officer, operator or tenant thereof, is frequented by persons <br />under the influence of illegally obtained controlled substances or marijuana or is used for <br />the illegal possession of, manufacturing or distributing controlled substances or <br />marijuana, shall be deemed a common nuisance. Any such owner, lessor, agent of any <br />such lessor, manager, chief executive officer, operator or tenant who knowingly permits, <br />establishes, keeps or maintains such a common nuisance is guilty of a Class 1 <br />misdemeanor. <br /> <br /> BE IT FURTHER ORDAINED that an emergency exists and that this ordinance <br />shall be effective on and after this date." <br /> <br /> <br />
